These Terms govern your use of getpetalplush.com and any purchase you make from us. By placing an order, you agree to them.
Who we are
This site and store are operated by:
"We," "us," and "Petal & Plush" refer to Advantage Advisors LLC. "You" refers to the customer.
Made-to-order products
Every pillow is custom made from a photo you provide. Because each item is personalized and produced specifically for you, it is not a stock product and cannot be resold to another customer.
How ordering works
While our production capacity is ramping up, orders are handled on a backorder basis, and you choose how to order at checkout:
- Prepay: you pay in full now, receive a discount, and your pillow ships in approximately 30 days.
- Reserve: we place no charge today. We hold your spot and email you when we begin your pillow. You may cancel a reservation at any time before production begins, at no cost.
Estimated production and shipping times are estimates, not guarantees, and can vary with demand.
Pricing and payment
Prices are in U.S. dollars. Applicable sales tax and shipping are shown before you pay. Payments are processed securely by Stripe; we do not store your full card details. By paying, you authorize the charge shown at checkout.
Your photos and the license you give us
When you upload a photo or submit a story, you confirm that you own it or have permission to use it, and that it does not infringe anyone's rights. You grant us a limited license to use, reproduce, crop, and edit the photo solely to create and deliver your product and to provide customer support.
We will not use your uploaded photo for marketing without your separate permission. Stories you submit through our story page are used only as described on that page and according to the consent you give there.
Proof approval
For custom orders we may send you a proof of your pillow design. We begin final production after you approve the proof. Approving the proof confirms the design is correct; please review it carefully, as we produce what is approved.
Returns and our 60-day love-it guarantee
Because our products are custom made for you, they are generally not returnable for reasons of preference (for example, choosing a different photo after approval). That said, we stand behind our work with a 60-day love-it guarantee: if your pillow arrives damaged, defective, not matching your approved design, or you are simply not happy, contact us within 60 days of delivery and we will remake it or make it right. Cancellations and refunds
Reservations can be canceled any time before production begins, with no charge. Prepaid custom orders can be canceled for a refund before you approve your proof and before production begins. Once a proof is approved and production has started, prepaid custom orders are generally non-refundable except under the love-it guarantee above.
Acceptable use
You may not submit photos or content that are unlawful, infringing, sexually explicit, hateful, or that depict others without their consent. We may decline or cancel any order that violates these terms and will refund amounts paid for a declined order.
Intellectual property
The Petal & Plush name, logo, site design, and content are our property. You keep all rights to the photos and stories you provide, subject to the license above.
Disclaimers and limitation of liability
The site and products are provided "as is" to the fullest extent permitted by law. We are not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.
Indemnification
You agree to indemnify us against claims arising from content you submit or your breach of these terms, including claims that your photo infringed someone's rights.
Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Pinellas County, Florida.
Changes
We may update these Terms from time to time. The "last updated" date above reflects the current version, and changes apply to orders placed after they are posted.
